General terms

we are pavleu, a company registered in Canada, Nigeria. We and our subsidiaries are referred to in this document as “pavleu”, “we” or “us”, access cards are sold and distributed by pavleu.com. The use and redemption of pavleu access card is between you and pavleu. By accessing this site, by purchasing an access card on pavleu.com, or by using a pavleu access card, you agree to be bound by the legal terms and conditions governing the sale and use of pavleu access card as defined by pavleu. pavleu reserves the right to revise these Legal Terms and Conditions at any time without notice, access cards cannot be used in conjunction with any other separate offer, promotion, negotiated benefit or agreement.
 
Foreign Exchange Rates 
Should the access card currency differ from the purchase currency for the goods redeemed, the exchange rate will be calculated as per the property’s calculated rate on the day of use.
 
Purchasing access cards
pavleu access cards must be purchased online and can be used for new reservations booked directly via pavleu.com, or authorised pavleu retail and experience locations.

Payment processing restrictions may apply in certain instances. Please contact pavleu customer service for further information and to proceed with payment if required.
 
Using your access card
You can apply your pavleu access card towards any pavleu experience in person– from accommodation to spa treatments and dining – at pavleu experience locations worldwide, access cards can be redeemed at pavleu experience locations where applicable for experiences, accommodation, packages, and experiences booked on pavleu.com or directly in person at pavleu experience locations. Access cards cannot be used with pre-paid reservations or any other offer, promotion, or rate published outside pavleu, or where restricted on pavleu.com. Access cards cannot be used for pre-payment, deposits, or booking guarantee purposes. For these, a valid credit or debit card will be requested to confirm your booking. Settlement at the end of your stay can be made with the available value of your access card.
 
Access Card Expiration
Access cards purchased are valid for 1 year from the date of issue and may not be redeemed beyond that period. pavleu access cards have no maintenance fees.
 
Returns
All sales of pavleu access cards are final. You may not return, cancel, redeem for cash or apply to any credit card balance any access card after it is purchased, unless otherwise stated by law.
 
Lost or Stolen Access Cards
Access cards have monetary value and should be protected accordingly. Ownership and risk of loss of access cards is transferred to the recipient of the access card immediately upon completion of processing of the order. pavleu will not refund or replace, and will not be liable for, any lost, stolen, copied or compromised access card, or any remaining value or balance on such access cards.

If you need assistance with the purchase of your access card, please contact pavleu customer support. Please have on hand all relevant information and be ready to provide your email address.
 
Delivery Information
All orders of access cards are subject to a process that compares information provided by you with information provided by your financial institution. If there is a discrepancy, your access card order may be delayed or held until the information can be verified. If such information cannot be adequately verified such order may be cancelled at the discretion of pavleu. If the date on which you want your access card delivered has passed and you have not received confirmation that the access card was sent, please contact pavleu customer support. pavleu is not responsible for access cards that are undeliverable, misdelivered or not received due to your failure to enter any accurate information, email address or other relevant delivery information for the recipient or sender.
 
Shipping for Physical Cards
Where available, orders for physical access cards placed before 10AM EST will be processed the same day and shipped. Orders placed after 10AM EST will most likely be processed the following day and shipped according to the shipping option chosen. Orders for access cards placed on legal holidays will be processed the following business day and shipped according to the shipping option chosen.
 
Limitation of Liability
NEITHER PAVLEU, OR OUR RESPECTIVE AFFILIATES OR SUBSIDIARIES MAKE ANY WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO ACCESS CARDS, AND DISCLAIMS ANY WARRANTY TO THE FULLEST EXTENT AVAILABLE. THIS INCLUDES, WITHOUT LIMITATION, NO EXPRESSED OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A ACCESS CARD IS NON-FUNCTIONAL AS A RESULT OF A MISTAKE OR ERRON MADE BY PAVLEU, YOUR SOLE REMEDY, AND PAVLEU'S SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH ACCESS CARD TO THE VERIFIED REMAINING VALUE OR BALANCE OF SUCH ACCESS CARD. CERTAIN STATE / PROVINCE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. IN THE EVENT THAT PAVLEU BECOMES INSOLVENT, MAKES A GENERAL ASSIGNMENT FOR THE BENEFIT OF CREDITORS, FILES A VOLUNTARY PETITION OF BANKRUPTCY, SUFFERS OR PERMITS THE APPOINTMENT OF A RECEIVER FOR ITS BUSINESS OR ASSETS, OR BECOMES SUBJECT TO ANY PROCEEDINGS UNDER ANY BANKRUPTCY OR INSOLVENCY LAW, WHETHER DOMESTIC OR FOREIGN, OR HAS WOUND UP OR LIQUIDATED, VOLUNTARILY OR OTHERWISE, ANY OUTSTANDING ACCESS CARD VALUE OR BALANCES (AND REMAINING VALUE OR BALANCES ON SUCH CARDS) WILL CEASE TO BE BE REDEEMABLE AT THE DISCRETION OF AND TO THE EXTENT DEEMED APPROPRIATE BY PAVLEU'S TRUSTEES OR APPOINTED LIQUIDATORS. IRRESPECTIVE OF PAVLEU'S CIRCUMSTANCES OR THE CIRCUMSTANCES OF PAVLEU'S TRUSTEES OR OTHER APPOINTED REPRESENTATIVES, UNDER NO EVENT SHALL PAVLEU BE LIABLE TO YOU OR TO ANY OTHER PARTY FOR THE VALUE OF ANY ACCESS CARDS, THE OUTSTANDING BALANCES ON ANY ACCESS CARDS OR REMAINING VALUE OR BALANCES ON ANY ACCESS CARDS.
 
Warranties
THIS SITE IS MADE ACCESSIBLE ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.
 
Indemnification
You agree to defend, indemnify and hold harmless pavleu, their affiliate, subsidiaries, and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of your use of this site.
 
Trademarks
You may not use the trademarks, logos, service marks or other proprietary designations of pavleu subsidiaries, and their respective directors, without obtaining prior legitimate written consent.
 
Disputes
The access cards are subject to the laws of Canada and any dispute relating to the access cards shall exclusively be adjudicated in the courts of Canada, without regard to principles of conflict of laws.
